By accessing our website or placing an order, you agree to these Terms of Service. Please read them before purchasing.
- ABOUT AVA LUCE
AvaLuce is an online beauty retailer offering skincare, cosmetics, body-care, fragrance and related products supplied directly or through approved fulfilment partners.
Our online store is hosted by Shopify, which provides the ecommerce platform used to offer products and process orders.
- ELIGIBILITY
You must be legally capable of entering into a contract to place an order.
If you are under 18, you must have permission from a parent or legal guardian before making a purchase. The adult giving permission is responsible for reviewing the order and these terms.
You must provide accurate, current and complete information when placing an order.
- PRODUCTS
We take reasonable care to ensure that product descriptions, images, ingredients, sizes and prices are accurate.
Product packaging, ingredients or presentation may occasionally be updated by the manufacturer before our website is updated. Colours may also appear differently depending on your screen.
Always read the packaging, ingredient list, directions and warnings supplied with the product before use. Do not rely solely on the information displayed on our website if you have allergies, sensitivities or specific health concerns.
AvaLuce does not provide medical advice. Product information is not intended to diagnose, treat, cure or prevent any medical condition.
- AVAILABILITY
All products are subject to availability.
Products supplied through fulfilment partners use stock information provided by those partners. On rare occasions, an item may become unavailable after an order has been submitted.
If we cannot supply an item, we will contact you and issue an appropriate refund. We are not obliged to supply an unavailable product or provide a substitute.
- PRICES
Prices are displayed in pounds sterling and include applicable UK taxes where required.
Delivery charges are calculated separately and displayed before payment.
We may change prices at any time, but changes will not affect an order that has already been accepted.
If a product is displayed with an obvious pricing error, we may reject or cancel the affected order and refund any payment made. We will normally contact you before doing so.
- PLACING AN ORDER
When you submit an order, you are offering to purchase the selected products subject to these terms.
Receiving an order-confirmation email does not necessarily mean that we have accepted the order. A contract is formed when we confirm dispatch or otherwise expressly accept the order.
We may decline or cancel an order where:
• A product is unavailable
• Payment cannot be authorised
• The order appears fraudulent or abusive
• Delivery is not available to the address supplied
• There is an obvious price or product-information error
• A purchase limit or promotional condition has been breached
If we cancel an order after taking payment, we will refund the relevant amount.
- PAYMENT
Payment must be made using one of the methods offered at checkout.
Payment services are provided by third-party payment processors. You confirm that you are authorised to use the payment method submitted.
We do not receive or store your complete payment-card number.
- DELIVERY
AvaLuce currently delivers within the United Kingdom only.
Products may be fulfilled and dispatched directly by different approved suppliers. An order containing products from more than one supplier may arrive in separate parcels and on different days.
Delivery charges and available delivery services are displayed at checkout. Further information is provided in our Shipping Policy.
You are responsible for providing a complete and accurate delivery address.
- CANCELLATION AND RETURNS
Your cancellation and return rights are explained in our Refund and Returns Policy.
For most eligible online purchases, you may tell us that you wish to cancel within 14 days of receiving the goods and then have a further 14 days to return them.
Exceptions may apply, including to sealed products that cannot be returned for health or hygiene reasons after their seal or protective packaging has been opened.
Nothing in these terms limits your statutory rights where products are faulty, damaged, not as described or unfit for their intended purpose.
- PROMOTIONS AND DISCOUNTS
Promotional codes and offers:
• Must be used within the stated promotional period
• Cannot be exchanged for cash
• May be subject to qualifying products, customers or minimum spending requirements
• Cannot be applied retrospectively
• Cannot be combined unless expressly stated
• May be limited to one use per customer or household
We may withdraw or correct a promotion where there is an error, misuse, fraud or a circumstance outside our reasonable control. This does not affect orders already validly accepted unless the offer was used fraudulently or contrary to its stated conditions.
- PRODUCT USE AND ALLERGIES
Beauty and skincare products can affect individuals differently.
You are responsible for:
• Reading and following the manufacturer’s instructions
• Checking ingredients before use
• Carrying out a patch test where recommended
• Discontinuing use if irritation or an adverse reaction occurs
• Seeking medical advice where appropriate
Contact a qualified healthcare professional before using a product if you are pregnant, breastfeeding, receiving medical treatment or have a condition that could affect whether a product is suitable.
This section does not exclude responsibility for a defective or unsafe product or limit any legal right you may have.
- REVIEWS AND USER CONTENT
If you submit a review, photograph, comment or other content, you confirm that:
• It is truthful and based on your genuine experience
• You have the right to submit it
• It does not infringe another person’s rights
• It is not unlawful, abusive, misleading or malicious
You give AvaLuce permission to display and reproduce submitted content in connection with our website and marketing, unless otherwise agreed.
We may moderate or remove content that breaches these terms, but we are not obliged to publish every submission.
- INTELLECTUAL PROPERTY
The content of this website—including AvaLuce branding, text, graphics, layouts and original imagery—is owned by or licensed to AvaLuce and is protected by applicable intellectual-property law.
Brand names, product names, logos and product imagery belonging to manufacturers or suppliers remain the property of their respective owners.
You may use the website only for personal, non-commercial shopping purposes. You must not copy, reproduce, distribute or commercially exploit its content without appropriate permission.
- ACCEPTABLE USE
You must not:
• Use the website for unlawful or fraudulent purposes
• Attempt to interfere with its operation or security
• Introduce viruses or malicious code
• Attempt to access restricted systems or information
• Scrape or harvest information without permission
• Submit false orders, reviews or account information
• Misuse discounts, promotions or referral schemes
We may restrict or terminate access where reasonably necessary to protect AvaLuce, its customers or its service providers.
- THIRD-PARTY SERVICES AND LINKS
Our website may use or link to third-party services, including Shopify, payment providers, delivery providers, social-media services and supplier websites.
We are not responsible for the content or independent practices of third-party websites. Your use of a third-party service may be governed by its own terms and privacy policy.
This does not affect AvaLuce’s responsibility for fulfilling its obligations to you as the retailer.
- OUR RESPONSIBILITY
We do not exclude or limit liability where doing so would be unlawful, including liability for:
• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Breach of rights that cannot legally be excluded
• Defective products where liability applies by law
If you are purchasing as a consumer, AvaLuce is responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill.
We are not responsible for losses that were not foreseeable, losses caused by circumstances outside our reasonable control, or business losses arising from a consumer purchase.
Nothing in these terms affects your statutory consumer rights.
- EVENTS OUTSIDE OUR CONTROL
We are not responsible for delay or failure caused by circumstances outside our reasonable control, such as severe weather, transport disruption, strikes, supplier interruption, network failure or government action.
We will take reasonable steps to minimise the effects and keep affected customers informed.
- PRIVACY
Our collection and use of personal information are explained in our Privacy Policy and Cookie Policy.
- CHANGES TO THESE TERMS
We may update these terms to reflect changes to our services, suppliers, technology or legal obligations.
The terms applying to an order are those in force when the order is placed. The latest version will be published on this page with its revision date.
- GOVERNING LAW
These terms are governed by the laws of England and Wales.
If you live elsewhere in the United Kingdom, you retain any mandatory consumer protections and rights to bring proceedings in the courts available to you under applicable law.
